Rental agreement terms

The rental agreement is legally valid once the tenant has received written confirmation of the booking. The contracting parties are the tenant as the recipient of the service and the service provider, i.e., the landlord (property owner). By registering, the tenant makes a binding offer to conclude the contract.

The minimum rental period is usually 7 days. 

Non-binding reservations, which entitle the guest to cancel free of charge, are only possible with a corresponding explicit agreement with the landlord. If no such agreement has been made, the booking generally results in a legally binding contract for both the landlord and the tenant. If, however, a non-binding reservation has been agreed upon, the guest must notify Mr. Johannes Kurzweil by the agreed-upon date if the reservation is to be treated as a binding booking. If this does not occur, the reservation is automatically cancelled without any further notification obligation on the part of Mr. Johannes Kurzweil.

On the day of arrival, the tenant can move into the house from approximately 5:00 PM. The tenant cannot claim damages should the house exceptionally not be available at this time.

On the day of departure, the holiday home must be returned by approximately 10:00 AM in the same condition as when it was received. The tenant is liable for any missing or damaged items. The tenant is also responsible for any pets brought along. Kitchen appliances such as pots, pans, dishes, etc., must be left clean upon departure. Please take care of your personal belongings. We accept no liability or responsibility for lost or forgotten items of any kind.

The holiday home is rented fully furnished. Bed linen, towels, and tea towels are not provided; these are included in the rental price for the duration of your stay. The specific terms and conditions are detailed in the current price list.

Upon signing the rental agreement, 50% of the total rental price is due. The remaining balance must be received in the landlord's account no later than four weeks before the start of the rental period. For short-notice bookings, immediate payment of the full amount is requested. A security deposit of €500.00 is also required. This deposit will be refunded promptly upon confirmation that the property is in good order. Any deductions for damages will be made from the refund.

The tenant is obligated to treat the holiday home with care and ensure that their fellow travelers, family members, and guests also comply with the rental conditions. They are required to report any damage incurred – even if not their fault – to the landlord immediately. Grilling with an open fire or charcoal is strictly prohibited; in case of violation, the landlord may terminate the rental agreement with immediate effect.

The conclusion of the rental agreement obligates both contracting parties to fulfill the contract, regardless of its duration. Unilateral and cost-free cancellation of a binding booking by the guest is generally excluded. Should the tenant nevertheless cancel the contract, the following costs will apply:

25% up to 6 weeks before the start of the trip

50% up to 2 weeks before the start of the trip

100% cancellation fee starting two weeks before the start of the trip

If the tenant does not occupy the holiday home within three days of the arrival date, the landlord has the right to rent the holiday home to someone else, and the tenant is then entitled to compensation of 100%. In the event of a later arrival or earlier departure than stipulated in the rental agreement, the tenant is not entitled to a refund of any part of the rental price.

Should your travel date (the day of arrival applies) be affected by an official travel ban from Greece or Germany, we offer in these cases a free rebooking to a later travel date or a 100% refund of your payments made up to that point via bank transfer.

The tenant is not permitted to accommodate more people than specified in the rental agreement. In individual cases, exceptions may be granted after consultation with the landlord and for an additional fee.

Warranty claims, claims for damages and other claims of any kind against the landlord cannot be asserted; these are excluded to the extent permitted by law.

The traveler is obliged to report any defects or damage to the rental property or its equipment occurring during the rental period immediately to the landlord or his representative (e.g., caretaker).

The building manager is authorized to receive notices of defects on behalf of the owner and to arrange for the necessary remedial action. The guest is obligated to cooperate in the rectification of any defects to the extent reasonable and to refrain from any action that hinders their repair. If the guest fails to report a defect immediately, they are liable to the owner for any resulting damages. Furthermore, the guest forfeits their right to a rent reduction or compensation to the extent that the owner could have remedied the defect had the notice been given in a timely manner (§ 536c BGB). Notices of defects can be submitted by email or via the contact details provided in the rental agreement.

Our holiday home has a satellite TV connection. Due to weather conditions, picture and sound interference may occur, which does not constitute a travel defect if certain television programs are temporarily unavailable or cannot be received. All free-to-air channels that are not encrypted or otherwise restricted from free reception can be received.

We cannot guarantee, warrant, or accept liability for the free Wi-Fi access should it be unavailable at any time. Since this is provided by a third-party provider, we have no control over its continuous availability or bandwidth. The Wi-Fi connection may fluctuate, potentially making streaming or extensive downloads or uploads technically impossible at times. As the Wi-Fi is offered free of charge, there is no legal entitlement to its availability.

Claims arising from the rental agreement must be asserted against the landlord (=homeowner) within 30 days of the contractually agreed end of the trip, otherwise they expire. 

Use of this holiday property is expressly at your own risk! Smoking is not permitted inside the house. Noise, music, and similar activities that disturb the neighbors are prohibited.

Some of the photos shown are examples, but all are of our house. To avoid misunderstandings, please be sure to specify any important requirements (e.g., fenced garden, Wi-Fi, or sun loungers) when making your inquiry or booking. We cannot accept subsequent complaints regarding missing items shown in the example photos. 

Should any provision be invalid, this shall not affect the validity of the remaining provisions. Amendments and modifications to the rental terms must be in writing.
